KUTHULU Terms and Conditions

1. Acceptance of Terms

This document outlines the Terms and Conditions (ToC) for using KUTHULU, a decentralized blockchain-based social media platform. By accessing or using KUTHULU, users acknowledge and agree to these terms. If you do not agree to these terms, you should refrain from using the services provided by KUTHULU. It is important for users to understand that these terms form a binding legal agreement between them and KUTHULU.

2. User Data and Privacy

2.1 Public and Unencrypted Data

All data shared on KUTHULU, including posts, comments, and personal information, is stored on the blockchain. This means it is publicly accessible and unencrypted. Users are responsible for any personal data they choose to share. However, while KUTHULU cannot remove or censor data on the blockchain, we retain the ability to block offending posts and users from being visible within the app, in accordance with our community standards and user reports.

2.2 Handling of Offensive Content

In cases where content is reported as offensive or objectionable, KUTHULU will take appropriate action within the app's environment. This includes blocking access to offending posts and, if necessary, suspending or banning the users responsible for such content from the app, despite the permanence of their data on the blockchain.

3. Content Policy

3.1 No Content Moderation

KUTHULU operates on a principle of free expression and does not moderate content. Users are encouraged to share freely but are solely responsible for the content they post.

3.2 Permanence of Content

Due to the immutable nature of blockchain technology, content published on KUTHULU is permanent and cannot be edited or removed. Users should consider the long-term implications of posting content.

4. Intellectual Property

4.1 Ownership of KUTHULU IP

All software, code, proprietary methods, and technologies used in KUTHULU are the intellectual property of KUTHULU.

4.2 User Content

While users retain ownership of the content they post, by using the platform, they grant KUTHULU a non-exclusive, royalty-free license to use, reproduce, and display such content in relation to the operation of the platform.

5. Liability

5.1 Decentralized Nature of the App

KUTHULU operates as a decentralized platform. This means there is no central authority, ownership, or team responsible for managing the platform’s content or interactions.

5.2 User Responsibility

Users acknowledge that they use the app at their own risk. KUTHULU does not offer support, and there is no mechanism for dispute resolution or remediation on the platform.

6. Cryptocurrency Use

6.1 Currency Utilization

KUTHULU integrates MATIC for blockchain transactions and DOOM as an in-app currency. Users can engage in various transactions using these currencies.

6.2 Tipping and Swapping

Users have the ability to tip other users with any ERC-20 token on the Polygon network. Additionally, there is a feature to swap MATIC for DOOM tokens within the app, facilitating various app-specific functionalities.

7. Eligibility

7.1 Age and Jurisdiction Restrictions

Users must be at least 13 years old to use KUTHULU. Additionally, users must reside in a jurisdiction where the use of blockchain technology and cryptocurrencies is legal.

8. Amendments to Terms

8.1 Updates to ToC

KUTHULU reserves the right to update these Terms and Conditions. Amendments will be published in the app and on the website Kuthulu.xyz. Users are encouraged to review the ToC periodically to stay informed of any changes.

9. User Conduct and Content Moderation

9.1 Zero Tolerance for Objectionable Content

KUTHULU has a strict zero-tolerance policy for objectionable content or abusive behavior. This includes, but is not limited to, content that is offensive, threatening, defamatory, or promotes illegal activities. Users who post such content or engage in abusive behavior will be subject to immediate action, including removal from the platform.

9.2 Reporting and Filtering Objectionable Content

Users can report objectionable content within the app by navigating to Settings > Report Post. KUTHULU is committed to maintaining a safe and respectful platform and will review reported content promptly. The developer will act on reports of objectionable content within 24 hours by removing the content and, if necessary, ejecting the user responsible for the offending content.

9.3 Responsibility for Content

While KUTHULU encourages free expression, users are solely responsible for the content they post. Users must ensure that their content adheres to these terms and respects the rights and dignity of others.

10. Account Management

10.1 Self-Sovereign Accounts

Accounts on KUTHULU are self-sovereign, linked directly to users’ Ethereum wallets. This provides users with full control over their accounts.

10.2 Termination and Deletion

Account management, including termination or deletion, is handled by users through their Ethereum wallets. KUTHULU does not have the ability to access or manage user accounts.

11. Compliance

11.1 Lack of Regulatory Compliance

KUTHULU is not structured to adhere to specific regulatory frameworks such as GDPR. Users are responsible for ensuring their use of KUTHULU complies with local laws and regulations.

12. Disclaimers and Limitation of Liability

12.1 “As Is” Basis

KUTHULU is provided without warranties of any kind, either express or implied. Users acknowledge that they use the service at their own risk.

12.2 Limitation of Liability

KUTHULU shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the service.

13. Governing Law

These Terms and Conditions shall be governed and construed in accordance with the laws of the jurisdiction in which KUTHULU is operated, without regard to its conflict of law provisions.
